Terms of Participation: Make every picture perfect with Galaxy AI

Make every picture perfect with Galaxy AI Campaign (the “Campaign”) is being run by Samsung India Electronics Private Limited (“Samsung”) on Samsung Members App (hereinafter referred to as the “App”).

This Campaign will start from June 12th, 2024 till closure announced by Samsung at its sole discretion and shall be valid for all App users who have attained the age of 18 years or above, except employees and family members of Samsung and its affiliate / associate / subsidiary companies and their suppliers, advertising agencies, authorized third party agency and event management companies (“Participants”).

Samsung will roll out photo contest inviting entries from the Participants for the Campaign.

For participating in this Campaign, Participant(s) need to share the photographs clicked by them from their Samsung Galaxy devices only where they have used Galaxy AI Photo Assist feature and share both before and after edit pictures on the Contest forum of Samsung Members App using title ‘Make every picture perfect with Galaxy AI’ and mentioning #Samsung Members #GalaxyAI #GalaxyS23 Series with their photography entries.

In the absence of the above-mentioned hashtags in the title/ post, the entries of the participants may be disqualified at our sole discretion and no claims shall be entertained in this regard.

Samsung or its authorized third party agency will run a randomizer to select 11 best entries from top most liked 100 valid entries received during the tenure of the Campaign and announce top 11 photographs post the closure of the contest on the App. The shortlisted pictures (11) will be featured on the Members community through Admin Post.

There will be eleven (11) winners selected by Samsung or its authorized third party agency using a randomizer. First (01) Winner will be eligible to receive 01 e-store voucher worth Rs. 25000 as a bumper prize out of eleven winners. Besides that, next five (05) winners will receive eStore vouchers worth Rs 15000/- each and last five (05) winners will receive eStore vouchers worth Rs 10000/- each, from Samsung on submission of the relevant information/documents being copy of PAN Card (Self attested), Photo ID Proof i.e. copy of Driving License or Passport or Voter ID Card or Ration Card (Self attested), Address proof: Driving License / Passport / Voter ID Card /Electricity Bill (shouldn’t be more than 6 months old) (Self attested) in the manner and within such time period as provided in the email which shall be sent to him/her informing about the results. Samsung reserves the right to ask for any other information as it deems fit, in relation to giving the Prize. The eStore voucher can be redeemed at Samsung Shop (Samsung website i.e. Samsung.com/in or Samsung shop app). The eStore voucher shall be valid from the date of issuance till 31st December 2024.

Winners shall be announced by Samsung or its authorized third party agency and uploaded on App accordingly from time to time. Winners shall also be informed through their registered e-mail/phone number.

Prize(s) shall be at the sole discretion of Samsung and shall be on As Is basis and winners will have to bear any and all applicable taxes including but not limited to GST or any other statutory tax or levy.

Upon receipt of the documents and after verification of the information provided by the winner, Samsung or its authorized third party agency shall arrange for sending the Prize(s) to the winners in the suitable mode i.e. mail/sms/courier. In case of any product, the same will be dispatched to the winner through courier at the address which is mentioned on the address proof submitted by the winner. In case the winner requests for a delivery of the prize at a different address, he/she shall be required to bear the cost of the courier or any additional cost as will be informed by Samsung, however, the said different address should be within India only. The Prize will be dispatched to the Winners within eight (08) weeks post receiving the required verification documents from them. The Winner shall be sent emails informing them of the dispatch details/POD number / Airway Bill Number (AWB) for the courier enabling them to track the status of their Prize.

In the event the Winner is unreachable, ineligible, fails to submit the relevant documents or submits false / forged & fabricated documents, or fails to pay the applicable taxes (if any) or fails to claim the Prize within the 06 days from email communication by Samsung, the Prize shall stand forfeited and no claims shall be entertained in this regard either against Samsung or its authorized third party.

The Prize(s) cannot be exchanged with any product or item, is non-transferable and cannot be en-cashed under any circumstances.

The participation in the Campaign is voluntary. Participation in this Campaign constitute acceptance of these terms and conditions. By participating in this Campaign, Participant agrees to receive communication(s) from Samsung and/or its authorized third party agency relating to the Campaign and Participant unconditionally agrees not to make any claim or raise any complaint against Samsung and/or its officers, directors, employees, subsidiary or any authorized third party agency in this respect.

Further, Participant gives Samsung the right (in perpetuity) to publish and broadcast anywhere in the world, for editorial, advertising, promotional, marketing and/or other purposes and in any media channel (including but not limited to social media platforms/official website/OOH/POSM/Print Media etc), Participant’s and/or Winner’s entry/content (in part or full), his/her name, image, likeness and/or photograph (except where prohibited by law) without any further permission or consent or consideration in any form, including but not limited to, royalty.

Participant agrees that Samsung shall not be liable for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any Prize (except any liability which may not be excluded under applicable law).

Participant hereby agrees that all/any entries posted with regard to the Campaign is their responsibility and further agrees to indemnify and keep Samsung, its associated companies, its event management company, its authorised third party agency and their respective directors, officers, employees, contractors and agents, indemnified against any and all losses, claims (including but not limited to third party claims), injuries, costs, fees, fines, penalties, taxes, charges and any other liability arising out of any act of omission, commission, fraud, negligence or misconduct by the Participant.

Participants shall not post any profanity or abusive comments on the Samsung’s page. In the event of any such profanity or abusive comments posted on foregoing pages, Samsung reserves its rights, in addition to removing such post, to take a legal action against such Participant and/or user.

Samsung reserves the right to change, extend, amend and/or withdraw the Campaign or change any of these terms & conditions or replace the Prize(s) anytime at its sole discretion without prior notice.

All disputes shall be subject to exclusive jurisdiction of courts located in Delhi.
