Terms of Participation: S20 FE Fan Squad campaign

1. S20 FE Fan Squad campaign (“the Campaign”) is being run by Samsung India Electronics Private Limited (“Samsung”) on Samsung Members App (hereinafter referred to as the “Members App”).

2. This Campaign will start from 12 October, 2020 till closure announced by Samsung at its sole discretion and shall be valid for all Samsung Members App users who have attained the age of 18 years or above, except employees and family members of Samsung and its affiliate / associate / subsidiary companies and their suppliers, advertising agencies and event management companies (“Participants/Users”).

3. In this Campaign, Users will use “spin the wheel” function in Members App to be assigned to one of the five (05) teams. These teams will be assigned randomly. Once a team has been assigned to a User, it cannot be changed and no request for the same will be entertained.

4. Participants will be given new tasks every 2-3 days (11 activities will be there in total). They can participate in the tasks to increase the chances of winning. Each task will be visible from its announcement till end of the Campaign.

5. Samsung or its authorized third party will assess publically available social listening data as well as data from Members App to determine which team is most active. Data source and calculation will be as per below table –

7 - tweets with correct hashtags - Social Listening data - total tweets for each hashtag - 6%
8 - Publically visible content with Hashtags on SNS - Social Listening data - total posts for each hashtag - 10%
9 - Publically visible content with Hashtags on SNS - Social Listening data - total posts for each hashtag - 15%
10 - Comments on Admin Posts with correct hashtags - SNS Admin data - total comments for each hashtag -6%
11 - Publically visible content with Hashtags on SNS - Social Listening data - total posts for each hashtag - 15%
6. Activity nos. achieved will be calculated from data collected on last day of Campaign. This number will be multiplied with weightage. Total score for each team will be sum of individual score for each activity. Winning team will be one with highest score.

7. Top Users (with maximum contribution to team score) will be contacted on their respective social media handles via Samsung handle for confirmation of their IMEI/Campaign registration details on Members App. In case of tie, randomizer will be used to determine the winner. Individual winners will be selected as per below schedule (total number to be determined at Samsung’s discretion basis quality of participation). The results shall be final and no claims shall be entertained in this regard.

- From 1 winning team - Up to 20 top Users (max contribution to team score)

- From 4 other teams - Up to 3 top Users (max contribution to team score)

8. Each final selected winner will be eligible to receive one (01N) S20 FE device / eStore voucher for S20 FE device from Samsung on submission of the relevant information/documents being copy of PAN Card (Self attested), Photo ID Proof i.e. copy of driving license or Passport or Voter ID Card or Ration Card (Self attested), Address proof: Driving license / Passport / Voter ID Card /Electricity Bill (shouldn’t be more than 6 months old) (Self attested) in the manner and within such time period as provided in the email which shall be sent to him/her informing about the results. Samsung reserves the right to ask for any other information as it deem fit, in relation to giving the Prize.

9. Winners shall be announced by Samsung or its authorized third party agency and uploaded on Members App accordingly. Winners shall also be informed through registered email/phone number.

10. Prize(s) shall be at the sole discretion of Samsung and shall be on As Is basis and winners will have to bear any and all applicable taxes including but not limited to GST or any other statutory tax or levy.

11. Upon receipt of the documents and after verification of the information provided by the winner, Samsung or its authorized third party agency shall arrange for sending the Prize(s) to the winners in the suitable mode i.e. mail/sms/courier. In case of any product, the same will be dispatched to the winner through courier at the address which is mentioned on the address proof submitted by the winner. In case the winner requests for a delivery of the prize at a different address, he/she shall be required to bear the cost of the courier or any additional cost as will be informed by Samsung, however, the said different address should be within India only. The Prize will be dispatched to the Winners within eight (08) weeks post receiving the required verification documents from them. The Winner shall be sent emails informing them of the dispatch details/POD number / Airway Bill Number (AWB) for the courier enabling them to track the status of their Prize.

12. In the event the Winner is unreachable, ineligible, fails to submit the relevant documents or submits false / forged & fabricated documents, or fails to pay the applicable taxes (if any) or fails to claim the Prize within the stipulated time, the Prize shall stand forfeited and no claims shall be entertained in this regard either against Samsung or its authorized third party.

13. The Prize(s) cannot be exchanged with any product or item, is non-transferable and cannot be en-cashed under any circumstances.

14. The participation in the Campaign is voluntary. Participation in this Campaign constitute acceptance of these terms and conditions. By participating in this Campaign, Participant agrees to receive communication(s) from Samsung and/or its event management company relating to the Campaign and Participant unconditionally agrees not to make any claim or raise any complaint against Samsung and/or its officers, directors, employees, subsidiary or any authorized third party agency in this respect.

15. Further, Participant gives Samsung the right (in perpetuity) to publish and broadcast anywhere in the world, for editorial, advertising, promotional, marketing and/or other purposes and in any media channel (including but not limited to social media platforms/official website/OOH/POSM/Print Media etc), Participant’s and/or Winner’s entry/content (in part or full), his/her name, image, likeness and/or photograph (except where prohibited by law) without any further permission or consent or consideration in any form, including but not limited to, royalty.

16. Participant agrees that Samsung shall not be liable for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any Prize (except any liability which may not be excluded under applicable law). The Prize shall be on “AS IS” basis.

17. Participant hereby agrees that all/any entries posted with regard to the Campaign is their responsibility and further agrees to indemnify and keep Samsung, its associated companies, its event management company, its authorised third party agency and their respective directors, officers, employees, contractors and agents, indemnified against any and all losses, claims (including but not limited to third party claims), injuries, costs, fees, fines, penalties, taxes, charges and any other liability arising out of any act of omission, commission, fraud, negligence or misconduct by the Participant.

18. Participants shall not post any profanity or abusive comments on the Samsung’s page. In the event of any such profanity or abusive comments posted on foregoing pages, Samsung reserves its rights, in addition to removing such post, to take a legal action against such Participant and/or user.

19. Samsung reserves the right to change, extend, amend and/or withdraw the Campaign or change any of these terms & conditions or replace the Prize(s) anytime at its sole discretion without prior notice.

20. All disputes shall be subject to exclusive jurisdiction of courts located in Delhi.
